Common Questions

Frequently Asked Questions

Straightforward answers to questions we hear most often from businesses and creators.

How long does a trademark registration take in Malaysia?
Standard processing with MyIPO typically spans eight to twelve months from the date of filing. This timeline can be affected by examiner objections or third-party oppositions, both of which our team can help you navigate. We keep you informed at each stage.
Do I need a local representative to file a patent in Malaysia?
Foreign applicants filing directly with MyIPO are required to appoint a registered patent agent based in Malaysia. Bijak Counsel can act in this capacity, as well as coordinate filings under the Patent Cooperation Treaty (PCT) for those seeking broader international protection.
What does an IP portfolio audit involve?
Our audit process begins with a systematic review of your existing registrations, pending applications, and unregistered rights. We identify renewal deadlines, geographic coverage gaps, and opportunities to strengthen your position. The engagement typically runs four to eight weeks, concluding with a written action plan that includes cost estimates.
Are the prices listed all-inclusive?
The prices shown represent our professional fees for the core scope of each service. Government filing fees charged by MyIPO and any third-party disbursements are quoted separately before any work commences. We believe in transparent pricing — you will always know what to expect before agreeing to proceed.
Can you help with a trademark dispute or opposition?
Yes. While our primary focus is prosecution and advisory work, we can assist clients facing opposition proceedings or disputed marks. We assess the merits of each situation carefully and advise on the most practical path forward, whether that is contesting, negotiating, or considering alternative branding strategies.
How is client information handled?
All client matters are handled in strict confidence. Our practice is bound by professional obligations under Malaysian bar and IP practitioner regulations. Information shared with us for the purpose of obtaining legal advice is treated as privileged and is never disclosed without your express consent.
