Brand Registration for a Food & Beverage Launch

Challenge

A Selangor-based food manufacturer was preparing to launch a packaged beverage range under a new brand name. An initial search had not been conducted. The launch timeline was fixed and the client was concerned that conflicts might exist.

Approach

Bijak Counsel conducted a comprehensive availability search across the relevant Nice classes. One potentially conflicting mark was identified in a related class. Classification advice was provided to define the scope of the application in a way that minimised overlap while protecting the core use.

Outcome

The application was filed and passed examination without objections related to the identified conflict. The client's mark proceeded to registration within the standard timeline. A monitoring report was set up following registration to alert the client to new applications in the same class.

Patent Prosecution for a Manufacturing Process Innovation

January 2025

Challenge

An engineering company in Kuala Lumpur had developed a modified manufacturing process that reduced material waste. They wished to patent the process in Malaysia and explore PCT coverage for certain export markets. No patent work had been done previously.

Approach

A prior-art landscape analysis was conducted. The search identified several relevant documents, but the specific combination of process steps was found to be novel. A claim strategy memo was provided before drafting began. The specification was drafted with independent claims focused on the distinctive process elements.

Outcome

The application was filed with MyIPO and is currently in prosecution. A PCT application was also filed designating four export markets. The client has a documented claim strategy and receives quarterly status updates from our team.

Pre-investment IP Audit for a Technology Firm

Challenge

A Cyberjaya technology company approaching a funding round needed to present an organised and verified IP position to prospective investors. Their existing portfolio included trademarks, two pending patents, and several copyrightable software components with unclear ownership documentation.

Approach

The audit identified an unregistered trademark in active commercial use, two patents nearing key prosecution deadlines, and gaps in software copyright ownership assignment.
